Requesting a Judicial Hearing 

You can request a judicial hearing to challenge a Statutory Summary Suspension in the State of Illinois.  You must do so within 90 days of the notice.  Legally, there are only four valid reasons to contest a summary suspension:

  1. Were you properly arrested or not?
  2. Was there reasonable ENOUGH grounds to believe the driver of the vehicle was drunk? 
  3. Did the driver refuse to submit to chemical testing or not?
  4. If the driver did submit to a chemical test and the test revealed a BAC of .08 OR any trace of drugs.
 

**The summary suspension WILL be thrown out IF the court rules in favor of the driver. 

***Only about 15% of cases are thrown out in favor of the driver.
