Requesting a Judicial Hearing
You can request a judicial hearing to challenge a Statutory Summary Suspension in the State of Illinois. You must do so within 90 days of the notice. Legally, there are only four valid reasons to contest a summary suspension:
- Were you properly arrested or not?
- Was there reasonable ENOUGH grounds to believe the driver of the vehicle was drunk?
- Did the driver refuse to submit to chemical testing or not?
- If the driver did submit to a chemical test and the test revealed a BAC of .08 OR any trace of drugs.
**The summary suspension WILL be thrown out IF the court rules in favor of the driver.
***Only about 15% of cases are thrown out in favor of the driver.
